Terms of Service

These Terms of Service (“Terms”) govern your use of the Hirespot website at hirespot.co, the Hirespot app at app.hirespot.co, Spotter, the Hirespot MCP server, and any related services (together, the “Platform” or “Services”), provided by Hirespot (“Hirespot,” “we,” “us”). By creating an account, submitting information, or using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a company, you agree to these Terms for that company.

1. Use of Our Services

a) Eligibility

• You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services.
• By using our Services, you confirm that all information you provide is accurate and complete.

b) Account Registration

• To access certain features, you may be required to register for an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• If you suspect unauthorized access to your account, notify us immediately at privacy@hirespot.co.

c) Clients and Applicants

• “Clients” are businesses, and their authorized users, that use Hirespot to find, interview, and hire candidates.
• “Applicants” are people whose profiles are in the Hirespot candidate database.

2. Services and Payment

a) Service Description

• Hirespot is an AI recruiter. Clients describe who they need in a chat with Spotter, which searches the Hirespot candidate database and shows the best matches.
• Clients can review candidate profiles, video introductions, and CVs, book and record interviews, and, where offered, run payroll for the people they hire.
• We act as facilitators between businesses and candidates but do not guarantee specific outcomes, including that a candidate will accept an offer, perform as expected, or stay in a role.

b) Credits

• Some actions in Hirespot use credits, such as running a search or refreshing your candidate pool. Your credit balance is shown in the app.
• Credit prices and the number of credits each action uses are shown in the app and may change.
• Credits that have been used are not refunded, including when a hire does not work out. Hirespot does not offer a replacement guarantee.

c) Payments

• Payments are non-refundable unless otherwise stated in a separate agreement.
• You are responsible for any taxes that apply to your purchases.

d) Subscription and Billing

• You may cancel your subscription at any time, but cancellation does not entitle you to a refund.

e) Payroll

• If you use Hirespot to pay someone you hire, the fees and terms shown when you set up payroll also apply.

3. AI Results, Hiring Decisions and Interviews

a) AI results

• Search results, rankings, summaries, and transcripts are produced with automated systems and may be incomplete or inaccurate.
• You are responsible for your hiring decisions and for checking candidate information before you hire.

b) Fair hiring

• You agree to follow the employment, anti-discrimination, immigration, and tax laws that apply to your hiring.
• You may not use the Services to search for, rank, or reject candidates based on characteristics protected by law.

c) Interview recordings

• Interviews booked through Hirespot may be recorded and transcribed.
• You agree to get any consent the law requires from interview participants before an interview is recorded.

d) MCP server and AI assistants

• You may connect Hirespot to AI assistants that support MCP.
• You are responsible for the assistants you connect and for the actions they take with your account.

4. User Responsibilities

a) Compliance with Laws

• You agree to use our Services in compliance with all applicable laws and regulations.

b) Candidate Information

• Candidate information you access through Hirespot is confidential. Use it only to evaluate and contact candidates for roles at your company.

c) Prohibited Conduct

You agree not to:

• Use our Services for any illegal, fraudulent, or abusive purpose.
• Misrepresent your identity or affiliation with any person or entity.
• Attempt to disrupt or interfere with our Platform or Services.
• Scrape, copy, export, sell, or share candidate data, or use automated tools to access the Platform outside the features we provide.
• Contact candidates for purposes unrelated to a real role.

5. Intellectual Property

• Hirespot owns the Platform, including Spotter, the software, the design, and the Hirespot name and logo. You may not copy, modify, or reverse engineer them.
• You keep ownership of the content you submit, such as role descriptions and interview notes. You give Hirespot a license to use that content to provide and improve the Services, as described in our Privacy Policy.
• Hirespot may create and use aggregated, de-identified, and derived data from use of the Platform (“Aggregated and Derived Data”).

6. Disclaimer

• Hirespot provides its Services “as is” and does not guarantee uninterrupted or error-free performance.

7. Limitation of Liability

• To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.

8. Termination

• We reserve the right to suspend or terminate your access to our Services at our sole discretion if you violate these Terms.
• You may end our relationship at any time by closing your account.

9. Privacy

• Our Privacy Policy governs how we collect, use, share, and protect personal information, including candidate data and the requests you send to Spotter.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

10. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the United States.
• Any disputes shall be resolved through binding arbitration or in the courts of the United States.

11. Changes to These Terms

• We may update these Terms from time to time. Any changes will be effective upon posting on this website.
• Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
